I agree to waive and exclude all of my legal rights of action against Tangalife Pty Ltd and any related companies, entities, directors, employees or agents (together Tangatours) and I fully release and indemnify Tangatours for any loss, damage, personal injury or death I may suffer or sustain howsoever arising out of or in relation to my participation in the activities conducted or organised by or on behalf of Tangatours including without limitation, liability for any negligent act or omission, breach of contract or of statutory duty by Tangatours.

I acknowledge, agree, and understand that the recreational activities provided by Tangatours include dangerous activities that involve obvious and inherent risks.

By participating in these activities I accept any such risks voluntarily.

1. I acknowledge that I am undertaking an adventure activity (for example diving, snorkelling, boat travel, swimming, banana boating, kayaking, etc) with obvious risks in a maritime environment which could result in distress, exposure to the elements, injury or death by drowning or other causes.

2. I declare that my health and safety and that of other participants including those under my care will not be put at risk by me taking part. I have made Tangatours aware if I am taking any medication or have any current medical condition that may affect or limit my ability to participate in my chosen activity: for example but not limited to asthma, allergies, chronic sea-sickness, back or neck injury, cardiac conditions, hernia, seizures, epilepsy, recent medical procedures or pregnancy.

3. I acknowledge that in undertaking any activity conducted by Tangatours that the safety of both my property and my person are solely at my own risk.

4. I acknowledge that, despite taking all reasonable care, Tangatours does not warrant either expressly or impliedly my safety or the safety of others whilst participating in any activity conducted by Tangatours.

5. I agree to pay for any loss, damage or injuries caused by or resulting from my use of or attempted use of any of the equipment owned by Tangatours, or by my conduct in general while participating in a Tangatours activity. This includes late return, overloading (motorboats/kayaks/stand up paddleboards) or operating equipment in a way that damages other vessels or equipment.

6. I agree to abide by all rules and regulations communicated to me Tangatours and any directions regarding the use of equipment or participation in activities offered by Tangatours.

7. I agree to use personal protective equipment provided for each activity as instructed by Tangatours staff.

8. I declare that I am a competent and confident swimmer, and if not have specifically advised Tangatours staff of my level of swimming ability.

9. I declare that I am over the age of 18 years or if under the age of 18 years, my parent or Guardian have my permission to sign this Agreement on my behalf and I intend it to be binding upon me.

10. I agree to any promotional use of my image whilst participating in a Tangatours activity, or if not I have clearly made my objection known to Tangatours staff.
